Dealatch'te üç tür anlaşma yapılır: satış, devir ve kiralama. Üçünde de rolümüz aynıdır: iki tarafı buluştururuz, anlaşmanın tarafı olmayız. Bu sayfa, kimin neden sorumlu olduğunu örnekleriyle anlatır.

Dealatch'in rolü

Dealatch, kullanıcıların kendi ilanlarını yayınladığı bir aracı hizmet sağlayıcıdır. Satıcı, devreden, kiraya veren, alıcı veya kiracı değiliz; kimsenin adına sözleşme yapmayız, ödeme almayız, parayı tutmayız, malı görmeyiz ve teslim etmeyiz.

Bizim sorumluluklarımız

Platformu çalışır ve güvenli tutmak.
İletişim bilgini, iki taraf da latch atana kadar kimseye göstermemek.
İlanları yayından önce otomatik taramak; iletişim bilgisi, yasaklı ürün ve bariz dolandırıcılık kalıplarını engellemek.
Şikâyetleri incelemek, hukuka aykırı içeriği kaldırmak, kararlarımızı gerekçelendirmek ve itirazları bir kişiye inceletmek.
Coin'leri kurallara göre tutmak, harcamak ve otomatik iade etmek.
Kişisel verilerini Gizlilik Politikası, KVKK Aydınlatma Metni ve GDPR Bildirimi'ne uygun işlemek.
Yetkili mercilerin usulüne uygun taleplerine yanıt vermek.

Bizim sorumluluğumuzda olmayanlar

İlandaki bilgilerin doğruluğu; malın varlığı, durumu, ayıbı ve mülkiyeti.
Fiyat, ödeme, kapora, depozito, teslim ve iade.
Taraflar arasında yapılan sözleşmenin geçerliliği ve ifası.
Devir ve kiralama için gereken izinler, onaylar, tescil ve vergi işlemleri.
Tarafların birbirine karşı davranışı ve buluşmaların güvenliği.

Kullanıcının rolü

İlan veren (satan, devreden, kiraya veren)

İlanın doğru, güncel ve eksiksiz olmasından sorumludur.
İlan ettiği şeyi satma, devretme veya kiralama hakkına ve yetkisine sahip olmalıdır.
Gereken izin, ruhsat, onay ve belgeleri kendisi sağlar.
Ticari olarak satış yapıyorsa tüketiciye karşı yasal yükümlülükleri (cayma hakkı, garanti, fatura) kendisine aittir.

Karşı taraf (alan, devralan, kiralayan)

Ödemeden önce malı, belgeyi veya yeri kendisi inceler.
Karşı tarafın kimliğini ve yetkisini makul ölçüde doğrular.
Sözleşmeyi okur, anlamadığı noktada uzmana danışır.

İki taraf da

Kullanım Koşulları'na ve yasalara uyar.
Karşı tarafa saygılı davranır; taciz, tehdit ve dolandırıcılık yasaktır.
Sorun olduğunda uygulama içinden şikâyet eder.

Örnekler

1. Satış — ikinci el telefon

İlanı yayınlar, numaranı gizler, karşılıklı latch sonrası sohbeti açar. Karşılık gelmezse coin'i iade eder.	Telefonun kendisine ait olduğunu, çalıntı olmadığını ve ilandaki durumunu (kusurlar, pil sağlığı) doğru yazar.	Telefonu görmeden ve denemeden ödeme yapmaz; kalabalık, güvenli bir yerde buluşur; IMEI kaydını kontrol eder.

Telefon ayıplı çıkarsa bu, alıcı ile satıcı arasındadır. Satıcının kasıtlı olarak yanılttığı şikâyetle doğrulanırsa ilanı kaldırır, hesabı kısıtlar ve alıcının latch coin'ini iade ederiz.

2. Devir — kafe işletmesi

İlanı ve devir bilgilerini gösterir, hassas mali bilgileri yalnız karşılıklı latch sonrası paylaştırır. Devir sözleşmesinin tarafı değildir.	İşletmenin gerçek cirosunu, borçlarını, kira sözleşmesinin kalan süresini ve ruhsat durumunu doğru bildirir; mal sahibinin devre onayını alır.	Vergi, SGK ve icra borçlarını, kira sözleşmesini ve ruhsatı kendisi inceler; devri yazılı sözleşmeyle ve gerekirse avukat veya mali müşavir eşliğinde yapar.

Devir bedelinin ödenmesi, borçların devri, ruhsat ve tescil işlemleri tamamen taraflar arasındadır. Dealatch bunlardan hiçbirini yapmaz veya garanti etmez.

3. Kiralama — daire

Dealatch	Kiraya veren	Kiracı
İlanın kesin konumunu herkese göstermez, iletişimi karşılıklı onaya bağlar. Kira sözleşmesinin tarafı değildir, depozito tutmaz.	Mülkün sahibi veya kiraya vermeye yetkili olduğunu, kira bedelini, aidatı ve mülkün durumunu doğru yazar.	Daireyi görmeden kapora veya depozito göndermez; tapu veya yetki belgesini görür; yazılı kira sözleşmesi yapar.

Kira bedeli, depozito, teslim ve tahliye taraflar arasındadır. Daireyi görmeden para isteyen ilanı şikâyet et; bu, en yaygın dolandırıcılık kalıbıdır.

Her anlaşmada: peşin kapora gönderme, malı veya yeri görmeden ödeme yapma, ıssız yerde buluşma, kimlik veya banka bilgini paylaşma. Şüphelendiğin her ilanı veya kişiyi uygulama içinden şikâyet et.

Roles & Responsibilities

Three kinds of deal happen on Dealatch: a sale, a transfer and a rental. Our role is the same in all three: we bring the two sides together, and we are not a party to the deal. This page explains, with examples, who is responsible for what.

Dealatch's role

Dealatch is an intermediary service on which users publish their own listings. We are not the seller, transferor, landlord, buyer or tenant; we sign no contract on anyone's behalf, take no payment, hold no money, never see the item and do not deliver it.

What we are responsible for

Keeping the platform running and secure.
Not showing your contact details to anyone until both sides have latched.
Scanning listings automatically before they go live and blocking contact details, prohibited items and obvious fraud patterns.
Reviewing reports, removing illegal content, giving reasons for our decisions and having a person review appeals.
Holding, spending and automatically refunding coins according to the rules.
Processing your personal data in line with the Privacy Policy, the KVKK Notice and the GDPR Notice.
Responding to properly issued requests from authorities.

What we are not responsible for

The accuracy of a listing; whether the item exists, its condition, defects and ownership.
Price, payment, deposits, delivery and returns.
The validity and performance of the contract between the parties.
Permits, approvals, registration and tax steps a transfer or rental requires.
How the parties behave towards each other, and the safety of meetings.

The user's role

The lister (seller, transferor, landlord)

Is responsible for the listing being accurate, current and complete.
Must have the right and authority to sell, transfer or rent out what is listed.
Obtains any permits, licences, approvals and documents needed.
If selling as a business, carries the legal duties owed to consumers (withdrawal rights, warranty, invoicing).

The other side (buyer, transferee, tenant)

Inspects the item, the documents or the property before paying.
Takes reasonable steps to check the other side's identity and authority.
Reads the contract and takes professional advice where unsure.

Both sides

Follow the Terms of Use and the law.
Treat each other with respect; harassment, threats and fraud are prohibited.
Report problems through the app.

Examples

1. Sale — a used phone

Publishes the listing, hides your number, opens the chat after a mutual latch. Refunds the coins if there is no latch back.	Accurately states that the phone is theirs, is not stolen, and its condition (defects, battery health).	Does not pay before seeing and trying the phone; meets in a busy, safe place; checks the IMEI.

If the phone turns out to be defective, that is between buyer and seller. If a report confirms the seller deliberately misled, we remove the listing, restrict the account and refund the buyer's latch coins.

2. Transfer — a café business

Shows the listing and transfer details, and shares sensitive financials only after a mutual latch. Not a party to the transfer agreement.	Accurately discloses real turnover, debts, the remaining lease term and licence status; obtains the landlord's consent to the transfer.	Checks tax, social-security and enforcement debts, the lease and the licence; completes the transfer by written contract, with a lawyer or accountant where needed.

Payment of the transfer price, assumption of debts, licensing and registration are entirely between the parties. Dealatch does none of these and guarantees none of them.

3. Rental — a flat

Does not show the exact location publicly, and gates contact behind mutual consent. Not a party to the lease; holds no deposit.	Accurately states that they own or are authorised to let the property, the rent, service charges and the property's condition.	Sends no deposit before viewing the flat; sees the title deed or letting authority; signs a written lease.

Rent, deposit, handover and move-out are between the parties. Report any listing that asks for money before a viewing; it is the most common fraud pattern.

In every deal: do not send a deposit up front, do not pay before seeing the item or the place, do not meet somewhere isolated, and do not share identity or bank details. Report any listing or person you are unsure about through the app.
