SnapWake — Terms of Service

These Terms of Service ("Terms") govern your use of the SnapWake mobile application ("the App") provided by MobileUpp ("we", "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract to use the App.

2. Your Account

You may use SnapWake without an account, or sign in with Apple or Google to sync your data. You are responsible for maintaining the security of any account credentials and for any activity that occurs under your account. Notify us immediately at snapwake@mobileupp.com if you suspect unauthorized access.

5. Alarms and Reliance

SnapWake schedules alarms using Apple's AlarmKit (on iOS 26+) or comparable Android facilities. Alarm reliability depends on your device, OS configuration, battery state, and granted permissions. We make commercially reasonable efforts to deliver alarms on time but do not guarantee that an alarm will fire in every circumstance. Do not rely on SnapWake as the sole alarm for safety-critical events.

6. Camera and Motion Data

The App uses your device camera and motion sensors locally to verify object dismissal and step targets. This data is processed on-device and never uploaded to our servers. By using these features you confirm you have the right to capture the images and environments you scan.

7. Intellectual Property

The App, including its design, code, branding, sounds, and animations, is owned by MobileUpp and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

8. Third-Party Services

The App integrates with third-party services such as Apple, Google, Firebase, Supabase, RevenueCat, and Google AdMob. Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services or content.

9. Termination

You can stop using SnapWake at any time and delete your account in Settings → Delete Account. We may suspend or terminate your access if you breach these Terms or use the App in a way that may cause harm to us or other users. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability limits) will remain in effect.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, MobileUpp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for missed events arising from delayed or undelivered alarms, even if advised of the possibility of such damages. Our total liability for any direct damages is limited to the greater of (a) the amount you paid us for the App in the 12 months preceding the claim, or (b) USD 25.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Any disputes will be resolved in the competent courts of Istanbul, except where mandatory consumer protection laws of your residence apply.

13. Changes

We may update these Terms occasionally. The "Last updated" date reflects the latest revision. Material changes will be highlighted in-App. Continued use after changes means you accept the revised Terms.
